Odvolanie (appeal) is an official challenge to a decision (rozhodnutie) that you do not agree with. It is your legal way to ask for a case review if an institution refused or decided against you.
How it works
- Appeals are submitted to the same authority that issued the decision, and this authority then passes the case to a higher instance.
- The deadline is usually short — often 15 days from the delivery of the decision (check the poučenie section for the exact deadline).
- In the appeal, state what exactly you disagree with and add evidence.
Submit it in writing and keep proof of submission — a stamp with the date on a copy or a postal receipt for a registered letter. If the situation is complicated, it is worth seeking free legal aid or contacting organizations that help foreigners. Even a short, but timely submitted appeal keeps your case open. Be sure to keep a copy of the appeal with the institution's stamp of acceptance.
